A rewrite of Maxine Waters' consumer bill of rights, if early reports hold. House Democrats are discussing turning Waters' Crypto Investor and Consumer Bill of Rights into their own market structure bill next Congress, with more authority for the SEC and less for the CFTC, Bitcoin Magazine reported, citing an X post by journalist Eleanor Terrett and three industry sources who spoke with Democratic staffers. No bill text exists, and the details have not come from lawmakers. The plan would fold in Democratic CLARITY Act amendments that were not adopted and provisions Senate Democrats had agreed with Republicans before the failed September cloture vote, likely alongside ethics rules restricting crypto activity by the president and other federal officials. Waters is in line to chair the House Financial Services Committee in January, taking over from French Hill, the CLARITY Act's sponsor. The House version of CLARITY handed the CFTC most digital commodity trading, so a tilt toward the SEC would flip that split. Her bill of rights was blocked 4-8 by the House Rules Committee in July 2025, along with a proposal to bar members of Congress, presidents and vice presidents from issuing or endorsing digital assets. Arizona Senator Ruben Gallego told Bloomberg Law: "The industry and the Republicans screwed up. That was the best bill they were going to get."
